Won Affirmance On Behalf Of Child Of Denial Of Mother’s Motion To Vacate Default In Termination Of Parental Rights Proceeding.

Matter of Giselle H.G. (Vanessa G.) 176 AD3d 510 (1st Dept 2019)

In this termination of parental rights proceeding where I represented one of the children on an appeal by the mother of Family Court’s denial of her motion to vacate the findings that terminated her parental rights, the First Department accepted my arguments that Family Court providently exercised its discretion in denying the mother’s motion to vacate, as she failed to present a reasonable excuse for her failure to appear at the fact-finding and dispositional hearings, and failed to provide a meritorious defense to the petition to terminate her parental rights and that the mother failed to provide any details or documentation to support her claim that she was incarcerated on the date of the hearing.
