Secured reversal of finding that father had willfully violated order of protection
Matter of Nicola V. (Patrick V.), 134 AD3d 1131 (2nd Dept 2015)
In this appeal arising out of proceeding for the violation of an order of protection where my client was sentenced to four months incarceration, I secure a reversal where the Second Department adopted my argument that the petitioning agency failed to demonstrate beyond a reasonable doubt that the father willfully violated the order of protection requiring him, inter alia, to have no contact with the subject child except for agency-supervised visitation.
